Authorized Users:
Authorized Users means (a) persons affiliated with Licensee as students, faculty or employees of Licensee; (b) persons physically present in Licensee's facilities; or (c) such other persons as IEEE may, at the request of Licensee and in IEEE's sole discretion, authorize in writing to access the Licensed Products.
InterLibrary Loan License:
Licensee is authorized to permit Authorized Users to...(v) use a printed or electronically transmitted article for the purpose of interlibrary loans subject to the same limitations that apply to paper copies for that purpose made from the print edition of the publications. Specifically, copies must be made in compliance with Section 108 of the Copyright Act of the U.S. and with guidelines developed by the National Commission on New Technological Uses of Copyrighted Works (CONTU Guidelines), the text of which is available as part of U.S. Copyright Office Circular 21.
Electronic Reserves License:
Licensee is authorized to permit Authorized Users to... (vi) post up to fifty (50) single PDFs contained in the Licensed Products for the purpose of electronic course reserve on Licensee’s secure website.
Coursepacks License:
Licensee shall not, and shall not knowingly permit any Authorized User to... (vii) use or copy the Licensed Products for document delivery, fee-for-service use, or bulk reproduction or distribution of materials in any form including, but not limited to, coursepacks or any substantially similar commercial purpose.
Allowed Use:
...(a) Licensee is authorized to permit Authorized Users to do the following: (i) view and search the content of the Licensed Products; (ii) download a single article for the individual use of an Authorized User; (iii) print individual articles from the Licensed Products for the individual use of an Authorized User or for the use by other Authorized Users; (iv) make a reasonable number of photocopies of a printed article for the individual use of an Authorized User or for the use by or distribution to other Authorized Users; and (v) use a printed article for the purpose of inter-library loans subject to the same limitations that apply to paper copies for that purpose made from the print edition of the publications. Prohibited Use:
...(b) Notwithstanding any of the terms of subparagraph (a) under [Allowed Use], Licensee shall make every reasonable effort not to permit any Authorized User to: (i) except as specifically set forth in Section (a) (v) under [Allowed Use], allow anyone other than an Authorized User to use or access the Licensed Products: (ii) display or otherwise make any information from the Licensed Products available to anyone other than an Authorized User; (iii) permit or facilitate use of or access to the Licensed Products at non-Authorized Sites; (iv) transmit electronically, via e-mail or any other file transfer protocols, any portion of the Licensed Products; (v) download or attempt to download an entire issue or issues of a publication contained in the Licensed Products; (vi) create a searchable archive of any portion of the Licensed Products; (vii) use robots or intelligent agents to access, search and/or systematically download any portion of the Licensed Products; (viii) sell, re-sell, rent, lease, license, sublicense, assign, or otherwise transfer the Licensed Products or any rights granted...; (ix) use or copy the Licensed Products for document delivery, fee-for-service use, or bulk reproduction or distribution of materials in any form, or any substantially similar commercial purpose; (x) alter, modify, repackage or adapt the Licensed Products; (xi) make any edits or derivative works with respect to any portion of the Licensed Products including any text or graphics; (xii) delete or remove in any form or format, including on a printed article or photocopy, any copyright information or notice contained in the Licensed Products; or (xiii) combine any portion of the Licensed Product with any other material. (c) in the event Licensee becomes aware of any unauthorized use of the Licensed Products by an Authorized user or any use of the Licensed Products at an unauthorized site, Licensee shall notify IEEE of such unauthorized use and terminate such Authorized User's access to the Licensed Products.
