Authorized Users are those individuals officially affiliated with the Licensee for example, those serving in the capacity of employees, consultants under contract with the Licensee, full or part-time faculty and other teaching staff, and persons officially registered as full or part-time students. Others who are physically present at an Authorized Site (for example, walk-in patrons) may use the database from an Authorized Terminal but may not connect via telecommunications from locations outside the Authorized Site. Licensee shall supply...the complete names and addresses of all of its locations that are participating in this License, plus their ACS Account numbers, if available. Those locations listed...will be considered Authorized Sites. Any changes to the list...must be made in writing and approved by the ACS. Any changes to the list...may necessitate a change in the fees due under this Agreement...Access to the ACS Web Editions from within the Authorized Site is controlled by Internet Protocol (IP) addresses. Licensees are responsible for providing valid IP addresses for their organization...The form of these IP addresses must be acceptable to the ACS. Only those IP addresses submitted by the Licensee and listed...have access to the material. Licensee is responsible for providing reasonable security to ensure that only Authorized Users have access to its internal network. InterLibrary Loan License:
...Except as set forth in [Prohibited Use Section], Licensee may use the ACS Web Editions to fulfill requests for Interlibrary Loan (ILL) according to the provisions of the Agreement. Interlibrary Loan shall include requests to support non-commercial scholarly research by patrons of other libraries such as public, school or college libraries. An Authorized Users at the Library of an Authorized Site may obtain a copy of an article in PDF format (Portable Document Format) and transmit it to the ILL requesting Library by mail, fax, or electronic transmission. The Licensee may make up to 5 (five) free article copies from each ACS Journal title per year for Interlibrary Loan purposes under this Agreement. Additional requests may be fulfilled only if the applicable single copy fees are paid either to the Copyright Clearance Center or directly to the ACS through its single article sales procedures on the Web Editions. The Licensee is responsible for keeping records to show the number of ILL requests fulfilled from each title to the ACS Web Editions and the name of each requesting library. The Licensee shall send ACS a report once each quarter listing the number of requests per title and the names of the requesting libraries. The ACS reserves the right to audit these records during normal business hours, with reasonable notice. Such audit will not occur more than once per year, unless the Licensee is found to be lacking in its record keeping...
Allowed Use:
...All Authorized Sites will have access to the Web Editions of all journal titles subscribed to by the Licensee as listed...[University of Missouri-Columbia, University of Missouri-Kansas City, University of Missouri-Rolla, University of Missouri-St. Louis and Saint Louis University]...Licensee and Authorized Users may use an Authorized Terminal to view, download, or print individual articles, individual chapters, or other individual items from ACS Web Editions for their personal scholarly, research, and educational use in accordance with the terms of this Agreement. In addition, Licensee and Authorized Users may make a printed copy of individual articles for the internal or personal use of the others who are Authorized Users but who are unable to personally access the database...
Prohibited Use:
...Licensee agrees not to cancel any of its Current Print Subscriptions for the duration of this Agreement. Should the Licensee nonetheless cancel any Current Print Subscriptions, Licensee will not be entitled to any refund of unused subscription fees. Except as provided in [ILL Section]...Licensee agrees not to forward, transfer, sell, rent, or otherwise knowingly distribute or provide access to the contents of ACS Web Editions or any portions thereof, to any third party that is not an Authorized User as described herein. Articles and other information obtained from this service are not to be used for fee-for-service purposes such as document delivery and/or transmitted to non-subscribing institutions. ACS Web Editions may not be used to supply single articles to Interlibrary Loan requesters that are employed by a commercial organization or by a library that belongs to a for-profit company, without separate prior written approval of ACS. Licensee agrees not to modify, alter, or create derivative works of the materials contained in ACS Web Editions without prior written permission from ACS. Articles and other information obtained as a result of this License are not to be systematically downloaded, re-published in any media, print or electronic form. Articles may not be downloaded in aggregate quantities or centrally stored for later retrieval. Licensee is required to make all reasonable efforts to notify its Authorized Users of these prohibited uses and to notify ACS of any infringements of copyrights or unauthorized use of which they become aware. Licensee will cooperate with the ACS investigating any such unauthorized uses and taking reasonable steps to prevent a reoccurrence...Except as provided in [ILL Section], Licensee agrees not to forward, transfer, sell, rent or otherwise knowingly distribute or provide access to the contents of ACS Web Editions or any portions thereof, to any third party that is not an Authorized User as described herein. Copyright Statement:
The entire contents of ACS Web Editions, including individual journals, articles, book chapters, and other items within these materials are copyrighted by the ACS under the Copyright Law of the US (Title 17, U.S. Code), which is party to both the Universal Copyright Convention and the Berne Copyright Convention. Licensee agrees not to remove or obscure copyright notices. This License grants no copyright or ownership interests to Licensee for any of the material and proprietary information referred herein belonging to ACS.
